It confronts the legal and practical problems encountered in a farming divorce and sets out why the court’s approach to such cases is different. In particular, why there is often a departure from equality due to third party interests in a farming business or the often non-matrimonial nature of agricultural assets meaning that they cannot be sold if future generations are to continue to farm.

The book also highlights the key issues that arise in farming divorce cases, touching on partnership, company, and trust law, and provides some practical tips for lawyers who are instructed on a farming case.

ABOUT THE AUTHOR

Rebecca Christie is a Senior Associate at JMW Solicitors LLP. Working in one of the top-rated specialist family teams, her practice covers a wide range of family work, including high net worth divorce and financial matters, nuptial agreements and issues involving children.

Unusually for a family lawyer Rebecca has worked on cases that introduce different disciplines of law, particularly agricultural matters. Due to her experiences learned through practice, in November 2019, as a member of the Agricultural Law Association, Rebecca spoke at their annual conference on ‘Divorce and Farming’. She has also written several articles on the subject and also the Practice Note on the topic for Thomson Reuters’ Practical Law.

Rebecca has also been named as the Gold winner of the ‘Rising Star’ award at the Citywealth Powerwomen Awards 2020 and the Silver winner of ‘The Family Lawyer of the Year – Associate’ at the Citywealth Future Leader Awards 2019. In November 2020 she was shortlisted for ‘Family Young Lawyer of the Year’ at the Family Law Awards 2020.
